Step 1

What can I build?

New to building? Not sure where to start? What are covenants and how do I ensure that a design meets these?

Our friendly Land Sales Team has the experience and knowledge to guide you through the different factors to consider when starting your new home journey and some early advice on how our covenants work. This includes helping you set a budget and steps to get your finances pre-approved in writing so that you can proceed to the next step with confidence.


Step 2

Which block of land is best for me?
——

Size, orientation, setbacks, side access…. so many things to consider. Starting can often be the hardest part of the process. Make an appointment to come to our sales office and talk through what is important to you in more detail. We can piece together this important mix to help you narrow your choice of land we have available and place a block on hold while you work with builders.


Step 3

Choose your design and builder
——

After selecting your land and confirming your budget, it’s time to choose a design. We work closely with many of Townsville’s top building companies so if you let us know who you plan to start talking to, we can supply them with all the information to ensure you get a design that meets our Estate covenants and your budget.


Step 4

Contracting your land to secure your new home
——

The next step is to advance from your hold on a block to a contract. We will work with you to prepare a contract to present to your solicitor that meets your individual needs. Your contract will have a finance approval period to allow you to work through the details of your loan with your lender. Once you have confirmed your finance condition you will have a deposit due to secure the contract.


Step 5

Approval of your Covenant application

After working through the design process with your builder you will need to submit your design for approval with our team to be assessed against our covenants. This is an easy process of providing a copy of your site plan, elevations, floor plan, fencing detail, landscaping plan, and colour selections to our team to assess.


Step 6

Settlement of your land and starting construction
——

You land contract will then have a settlement period which is the date that the full amount for the land is due. If the land is already registered then 28 days is the standard time frame. If the land is purchased off the plans then the date will often be 14 days after the land registers. Now ownership will be yours and you can start building!

What Is a Covenant?

A “covenant” is an agreement between the estate developer and the purchaser of a block of land.

The Covenant sets out the standards for the construction of houses, landscaping, and streetscapes within the estate. It is basically a set of guidelines that sets the intention for the estate and is a vital tool in the transformation of a large parcel of vacant land into an established and thriving community.

Examples of what restrictions are commonly included:

  • Limiting development to only one house per lot

  • Minimum or maximum size of the dwelling

  • Dictating the types of building materials used, styles, and finishes

  • Landscaping and Fencing Requirements

Unlike zoning laws, which are enforced by government authorities, restrictive covenants are enforced by the landowners.


Why have Covenants?

Nearly all newly developed residential land for sale will have some form of covenant over them.  Developers create covenants to influence how the land is used, even after it is sold.

This enables effective parameters to the standard and quality of building in a subdivision, preserving the value of any remaining lots.  People can with confidence, buy into an estate and know the level of housing around them will be similar to that of the house they are designing. 

Moreover, many purchasers like to see this sort of regulation as it enhances and protects the asset they are buying by ensuring that nothing undesirable is built in the neighbourhood.


How to ensure your design will get Covenant Approval?

When you come in to discuss purchasing land in our estates we will guide you through the key points that will apply to the block of land you are interested in. 

We work closely with most of Townsville’s leading builders and will pass on a copy of the covenants to your designer so that they are aware at the beginning what is required. Once a concept has been drawn our sales team can assess it against our covenants and give any feedback before you commit to a purchase.
